Please read these Terms of Use ("Terms") carefully before using the ConfidAI mobile application ("App") operated by ConfidAI ("we," "us," or "our").
By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
The App is licensed, not sold, to you. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, as permitted by the Apple Media Services Terms and Conditions.

This license is effective until terminated by you or by us. Your rights under this license will terminate automatically if you fail to comply with these Terms.
We are solely responsible for the App and its content. Apple has no obligation to provide any maintenance or support services for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including but not limited to: (a) product liability claims, (b) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of any such claim.
You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
ConfidAI is an AI-powered language learning app that lets you practice speaking German through voice conversations with an AI tutor. Features include free conversation, role play scenarios, grammar practice, and vocabulary training.
The AI tutor is not a certified language instructor, translator, or linguistic authority. By using the App, you acknowledge and agree that:
You must create an account to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information during registration.
Each subscription tier includes a daily usage allowance for AI conversation time. When your allowance is used up, you will not be able to start new conversations until the following day. Unlimited tiers are subject to fair-use abuse guardrails. We reserve the right to modify usage limits, tier offerings, and pricing at any time.

The App and its content — including but not limited to the software, design, curriculum structure, grammar topics, and vocabulary lists — are owned by ConfidAI and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.
Conversations you have with the AI tutor are generated collaboratively between you and the AI. You retain rights to your own input. We may use anonymized, aggregated conversation data to improve the service.
Your use of the App is also governed by our Privacy Policy, available at confid.ai/privacy. By using the App, you consent to the collection and use of your data as described in that policy.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, reliability, or completeness of any AI-generated content.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONFIDAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or at confid.ai/terms. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Germany.
